Terms and conditions of use

By using this website you agree to be bound by the Terms and Conditions set out below. If there is anything that you want clarifying or if you think we have missed something please don't hesitate to contact one of the members of our sales team, who will be happy to answer any questions.

1. Prices

All prices on our website show both with and without VAT where applicable*. The only other additional cost will be postage and packaging which is clearly listed before you are asked to enter any credit card or other payment details into our website. Information about postage and packaging charges can be found below.

*Children's clothing is not subject to VAT and the prices listed for them do not include it.

2. Payment Methods

We only accept payment for orders in pound (£) sterling.

Our primary means of receiving payment from you is through debit and credit cards. 

In all cases the full amount owing for the goods you wish to purchase must be cleared by our payment handling company before we will ship any goods to you. This normally takes a matter of minutes after we charge your card but can be delayed if there are discrepancies in your card numbers or between the delivery address you have given to us and the address you have registered with the bank.

We make every effort to ensure that your card details are secure at the point of sale and we are able to confirm the transaction with our payment provider without storing card details in-house. No card details are stored at Business Present Limited.

3. Delivery Addresses

Due to increasing card fraud - we will only be able to offer delivery to alternative addresses if the online forms are submitted correctly - we cannot accept verbal instructions to deliver to an address other than the registered cardholder address.

Should you choose an alternative delivery address when submitting the online order form, please be advised that it becomes your responsibility to ensure that the address you have given for the delivery of your consignment is secure. Business Present Limited. accepts no responsibility for consignments being delivered to the incorrect address if the incorrect details are completed online. We will follow the delivery instructions given to us at the point of order.

4. Postage and Packaging

Any order you place within the mainland UK will be charged free over £50 order.

5. Delivery

All orders will be despatched within 5-10 working days.

All parcels will be delivered by carrier and will require a signature on delivery. If you are out when the carrier attempts to deliver your parcel, they will leave a card with a contact number for you to arrange a new delivery date. If a parcel is small enough to fit through a letterbox, it may be delivered by Royal Mail or DPD, which will not require a signature.

We only dispatch Monday to Friday so all delivery times are for working days only. Although we try and keep our stock levels and estimated dispatch times as up to date as possible we do occasional run out of products unexpectedly. If this happens we will inform you of any delays as quickly as possible.

Risk of loss and damage of products passes to you on the date when the products are delivered to you.

We always try to deliver the exact amount ordered, but sometimes shortages or extras are sent in error. You shall not be entitled to reject the whole consignment (or to refuse to pay for it) if there is a 5% variation in the quantity you ordered.

6. Risk/Title

The goods will be at your risk from the time of delivery.

Ownership of the goods will only pass to you when we receive full payment of all sums due in respect of the goods, including delivery charges.

7. Indemnity

The buyer shall indemnify the Company against all damage or injury to any person or company against all proceedings, charges and expenses for which the company may become liable in respect of the goods supplied by or on behalf of the company except to the extent that liability therefore has been expressly admitted in these conditions.

8. Contract

Your order to us constitutes an offer to purchase the goods in your order at the price in your order. We are under no obligation to accept this offer. Your order confirmation email is for you to check your details are correct and to show that we have received your offer.

The contract between Business Present Limited Ltd. and yourself is not complete until we have successfully delivered your goods to you. It will be assumed on our part that the contract is complete once our goods and our dispatched note is received by you.

9. Accuracy of information

We will take all reasonable care to ensure that all details, prices, photographic representations and descriptions of products appearing on the website are correct at the time when the relevant information was entered onto the system. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our products that appear on the website. What you see will depend on your monitor and computer equipment, we are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise.

If you do buy something from our site and feel that the picture or description was not accurate then you can return the item and we will refund you or offer an alternative product.

While every effort is made to ensure that accurate pricing and descriptions are maintained, we reserve the right to decline orders if they are based on inaccurate information by either party. A transaction is only deemed complete when full payment is made and the goods have been received by the cardholder.

10. Privacy

We collect certain information from you in order to process your order. This includes you name, address and card details. None of the card details are stored by Business Present Limited. Your name postal address and email address will be stored for our records but they will not be used for any other purpose except with your explicit written permission. Nor will they be passed onto any third party.

11. Order Cancellation

If, for any reason, you wish to cancel any order you have placed before it has been delivered and it has not been dispatched, please contact Business Present Limited sales team.

As it is our policy to try to process orders immediately it may not always be possible to stop an order from being dispatched. After dispatch our Returns Policy will apply.

12. Returns and Refunds

Your statutory rights are not affected by our Returns Policy. To the extent that any provision in our Returns Policy conflicts with your statutory rights, your statutory rights will prevail and the particular offending provision in our Returns Policy will be deemed inapplicable.

Returns (refunds and exchanges)

If you are unhappy with your item, please let us know. Our Returns Policy gives you 30 days to return or exchange an item bought online with a valid receipt. If 30 days have gone by since your purchase, we cannot offer you a refund or exchange. To be eligible for a refund or exchange, goods must be returned in a re-saleable condition. That means your item must be unused and in the same condition that you received it. The item must be in the original packaging and returned with any accessories, labels and “free gifts” or bonus items. To complete your refund or exchange, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer. 

Refunds (if applicable)

Once your returned item is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 14 calendar days. If you paid for standard delivery of the goods, the cost of standard delivery not refundable. 

There are certain situations where only partial refunds are granted (if applicable):

- Any item not in its original condition, which is damaged or missing parts for reasons not due to our error; and

- Any item that is returned more than 30 days after delivery. 

Late or missing refunds (if applicable) 

If you haven’t received a refund yet, first check your bank account again. Sale , Personalised and Christmas items

- We do not offer refunds for sale items, unless they are faulty.

- We cannot refund or exchange personalised or decorated garments.

- Christmas items and items in the sale are not returnable

Exchange (if applicable)

We only replace items if they are defective or damaged. If you need to exchange an item for the same item, please send us an email at info@james-and-nicholson.co.uk and post your item to: Business Present Limited, 20 Kynance Close, LU2 9DN.

Shipping

To return your product, please mail your product to: Business Present Limited, 20 Kynance Close, LU2 9DN with your details and reason for returning. You will be responsible for paying for your own shipping costs for returning your item, unless the item is faulty. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary. If you are shipping an item over £50, you should consider using a trackable shipping service or purchasing shipping insurance as we cannot guarantee that we will receive your returned item.

Right to cancel

In addition to our Returns Policy, if you are a customer in the European Union you have the right to cancel your contract with us and receive a full refund within 14 calendar days from the day after the date you received your order, if you are an online, mail or telephone order customer. If the goods are delivered in several instalments then it will be 14 calendar days from receipt of the last instalment. To exercise your right to cancel the contract you must request a refund in writing within 14 calendar days of receipt of the items. The refund will include any standard delivery charges paid. You will be responsible for the cost of returning a cancelled order to us. To exercise your right to cancel follow the steps below:

- Please fill the Merchandise return from the james-and-nicholson.co.uk website and include it with the items when you return them. We will refund to you the price paid for the items and (unless you did not pay for delivery) the delivery charges that you paid up to a maximum amount of the cost of our standard delivery option. You will be refunded to your original method of payment within 14 calendar days of our receipt of the cancelled items or, if earlier, within 14 days from the day we receive proof of return from you. If we do not receive the cancelled items back, we may arrange to collect them from you at your cost.
